Australia: Family visas to receive concessions for visa grants from early 2021

Many visas recently have received concessions due to the coronavirus pandemic. The same way family visas for Australia will receive benefits of concession and visa applicants in Australia do not need to leave to be granted their visa. The Acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs announced yesterday that COVID-19 concessions will apply to several family visas. These changes will come into effect in early 2021.

As the coronavirus pandemic has spread across world and some countries are still struggling with it, the applicant have to depart and have to reach such country and that might fill them with anxiety. Purpose of family visa is the reunion with family members who are Australian citizens and permanent resident. In addition, such situation affects the sponsors as well. Hence, the regulations for certain family visa along with some skilled visas will be amended to overcome such situation.

Most family visas have existed for many years and there was no major change in it until now. There have been some minor changes as per requirements. The regulation for family visa subclasses require that the application must be lodged offshore and applicant must be outside Australia at the time of visa is granted. Considering the current conditions, international travel, and the need to quarantine, requiring visa applicants to depart for the sake of granting a visa, which will then likely see them return to Australia soon after, now seems excessive.

The proposed changes will allow visa applicants for these offshore visas to have them granted while in Australia. The visas that will have the changes implemented are given below:

  • Subclass 309 – Partner visa
  • Subclass 300 – Prospective Marriage visa
  • Subclass 101 – Child visa
  • Subclass 102 – Adoption visa
  • Subclass 445 – Dependent Child visa

It is expected that these changes are for during concession period only and it will be applicable in several situations only as media release refers to temporary concessions. This is set to benefit approximately 4000 visa applicants, most of which lodged partner visas.
