USCIS completes H-1B cap lottery process for 2022

The US Citizenship and Immigration Services recently announced the completion of the H-1B cap lottery process for the fiscal year ending September 30, 2022. It has been announced that the pool has received e-registrations for H-1B quota of 85,000 applicants including for Masters’ cap which is sufficient to fill the available slots. It was second year that the e-registration process was adopted by the department.

The sponsoring employers have to fill the details H-1B cap application for the selected applicants in the lottery process from April 1. The employers are supposed to fill and submit the application in stipulated period which will last at least 90 days.

According to the Immigration attorneys, it is still not announced by the USCIS whether the premium processing will suspended for the application that are going to be filled. The department had suspended the premium processing at short notice that enabled the applicants to receive the judgement on their application within 15 days and speed up the process.

What is lottery process?

There is a lottery process to be eligible for the H-1B visa and just to be eligible for this lottery, the applications have to be pre-registered electronically. Then, once the winners of the lottery have been announced, full-fledged paperwork will have to be filed. The US Government Department responsible for issuing visas, the U.S. Citizenship and Immigration Services, informs people through its website regarding the status of the visa lottery. Each year, there is a cap for the maximum number of visas that can be issued. This cap is mandated by the US Congress that has to be adhered to. For this year, it was 85,000 candidates.

H1-B holders may be able to take up their job position from October 1, 2021 at the earliest provided their applications are accepted within the given time.
